HMB Homes Real Estate Development: the three years between contract and keys
A developer building in Discovery Gardens. Off-plan buyers do the work before signing and nothing afterwards — and the period in between is where problems are still cheap to catch.
An off-plan purchase takes years, and almost all buyer effort is spent in the fortnight before signing. The years afterwards are treated as waiting. They are not: they are the period in which a problem can still be identified while options remain.
What to do every quarter
- Check recorded construction progress against your payment schedule. This single comparison is the early-warning system, and it takes minutes.
- Look at the site. Ask your agent or a contact for photographs with a date. Cranes moving and people on site is information; a render is not.
- Confirm your payments were credited to the escrow account, and keep the receipts matched to milestones.
- Watch the developer's other projects. Trouble usually shows up somewhere in a portfolio before it reaches your building.
- Track what is completing near you. Supply arriving in the same year as your handover is what sets your rent, and it is knowable years ahead.
Dates to have in a diary
- The contractual completion date, and the point at which any grace period ends.
- When your delay remedy becomes available, and what it requires you to do to invoke it.
- When assignment becomes permitted, if there is a minimum paid percentage — this is when an exit first exists.
- Each payment milestone, so a request arriving early is visible as early.
What to do if something looks wrong
- Ask in writing and keep the answer. A pattern of vague responses is itself information.
- Get the project's official status rather than the sales office's description of it.
- Find the other buyers. A group has practical weight that an individual does not, in every route available.
- Take advice before withholding a payment. Non-payment can convert the developer's problem into your default, and that is a costly mistake to make on instinct.
Before handover
- Re-read the specification so you know what was promised.
- Book an independent snagging inspection for the handover date.
- Budget the connection costs — utilities, cooling deposits and any capacity charge start at handover regardless of whether anyone lives there.
- Line up a managing agent if you are overseas, so the property is not sitting idle while you arrange one.
The district note
